David Barbaree

David has a broad litigation practice, including commercial, civil, administrative, and regulatory matters. He has appeared at every level of court in Ontario, including the Divisional Court and the Court of Appeal for Ontario, the Ontario Securities Commission (OSC) and the Ontario Municipal Board. He has worked for clients on a range of issues, including shareholder and contractual disputes, class actions, employment, civil fraud, real estate disputes, and intellectual property.

David is currently a volunteer with the OSC Litigation Assistance Program that provides free legal assistance to unrepresented respondents to OSC administrative proceedings.

Prior to practicing in Ontario, David worked for the Queensland Department of Justice and Attorney General in Australia where he was involved in the prosecution of criminal offences. David was admitted as a solicitor in the State of New South Wales in 2009.

SELECTED CASES:

L’Ouvrier Inc. v. Leung, 2017 ONCA 589: successfully resisted appeal of summary judgment in a commercial lease dispute.

Enerworks Inc. v Glenbarra Energy Solutions Inc., 2016 ONSC 4291: after defending unsubstantiated allegations of fraud, successfully moved for substantial indemnity costs against plaintiff.

l’Ouvrier Inc. v Leung, 2016 ONSC 6993: successfully represented restaurant tenant in motion for summary judgment for breach of commercial lease. Damages included award for punitive damages.

Levita v Alan Crew et al., 2015 ONSC 5316: successfully defended claim of negligence against defendant recreational hockey league.

Harris v. Leikin Group Inc., 2014 ONCA 479: appeal concerning corporate governance and fiduciary duty.

Faas v Coloroso, 2014 ONSC 4494: successfully defended motion for costs for injunction motion adjourned to trial.

Shakes v. Ontario Racing Commission, 2013 ONSC 4229: judicial review of license suspension by Ontario Racing Commission.
